Professional Boundaries on Trial: Lessons from the Supreme Court

On December 3rd, Acsenda School of Management students had a unique opportunity to witness the complexities of legal proceedings firsthand at the Supreme Court of Canada in Vancouver, BC. Led by Associate Professor Dr. Sriram Ananthan, the group delved into a compelling case that examined the fine line between personal and professional communication in the workplace, reinforcing Acsenda’s commitment to Connecting People with Professions.

The case centered on an Executive Vice President of a construction corporation, the plaintiff, who was questioned about years of text exchanges with a colleague, Miss Carolyn. These messages, ranging from casual greetings to work-related discussions, were presented as evidence, challenging students to consider how everyday digital communications can be scrutinized in a legal context.

Behind the Case

The plaintiff detailed his professional history, outlining his responsibilities as a senior executive. This served as a foundation for examining the context and intent behind the text messages. The exchanges included:

  • Professional Greetings: Starting with a 2014 birthday wish, “Happy birthday. Hope you have a great day with family XO,” to a polite response, “Happy birthday to you too. Hope you had fun as well.”
  • Casual Conversations: Friendly messages like a 2016 note about Oreo cookies left in the freezer.
  • Coordinating Schedules: Discussions about evening plans, family commitments, and Easter greetings.
  • Workplace Matters: Messages related to scheduling and office updates.

The lawyer systematically questioned the plaintiff about each message, analyzing its relevance to workplace boundaries and professionalism.
